Terms & Conditions

The rules for using Robonito, including business testing, AI clients, and authorised automation.

Last updated:

1. Agreement and eligibility

These Terms & Conditions form an agreement between you and Robonito Pvt. Ltd., an Indian company trading as Robonito. They cover your use of our website, applications, test-automation platform, software, and MCP server (together, the “Service”).

Robonito Pvt. Ltd.
4/583 Firdaus Complex, Hamdard Nagar A, Aligarh, Uttar Pradesh 202002, India
Email: info@robonito.com

By using the Service, you agree to these terms. If you do not agree, stop using it. If you use Robonito for a business or another organisation, you must have authority to accept these terms on its behalf.

You must be at least 18 and have legal capacity to enter this agreement. You are responsible for complying with laws that apply to your use, including when accessing the Service from outside India.

The Service is not tailored to industry-specific requirements such as HIPAA or FISMA. Do not use it where your use requires compliance that the Service does not provide, or in violation of the Gramm-Leach-Bliley Act.

Supplemental terms posted for particular services also apply. We may update these terms by posting a revised version and changing the date above. Review them regularly; continued use after changes take effect constitutes acceptance, subject to applicable law.

2. Licence and intellectual property

Subject to these terms and your plan, we grant you a limited, non-exclusive, revocable, non-transferable licence to use the Service for your personal use or your organisation’s internal business purposes, including commercial software testing. You may download or print content you are authorised to access for those purposes.

Robonito and its licensors retain ownership of the Service’s software, designs, content, trademarks, and other intellectual property. Except as this licence or applicable law permits, you may not copy, redistribute, resell, or commercially exploit the Service or its content without our written permission. We reserve rights not expressly granted.

3. Your account

Provide accurate, complete, current registration information and keep it updated. Keep passwords, API credentials, and tokens confidential. You are responsible for use of your account and for granting access only to authorised people and clients.

We may suspend or terminate accounts with false or incomplete registration information. We may reclaim or change usernames that are inappropriate, obscene, or otherwise objectionable.

4. AI clients and authorised automation

You may access Robonito through its MCP server using AI clients and valid tokens issued by Robonito. This authorised access is expressly permitted despite restrictions on bots, robots, scripts, or other automated or non-human access elsewhere in these terms.

Use must remain within the permissions you grant, your plan limits, and applicable security and rate limits. Other automated access requires our permission, except ordinary browser use and standard search-engine indexing.

AI clients and their providers are third parties. Their services are governed by their own terms, privacy policies, and your agreements with them. Robonito’s terms do not replace those agreements.

You are responsible for the instructions, permissions, and actions you authorise an AI agent to carry out through Robonito, including creating or changing tests, running tests, and accessing or sharing results. Review permissions and outputs, protect credentials, and revoke access when it is no longer needed.

5. Authorised testing

Only test applications, systems, and data that you own or have permission to test. Your authorisation must cover the actions performed by Robonito and any connected agent, including access to page content and screenshots.

You are responsible for test instructions and their effects on the application under test. Obtain necessary permissions before sharing personal or confidential information with Robonito, an AI client, or an AI provider.

6. Fees and payment

Some services require payment. Provide accurate billing and payment information and keep it updated. You agree to pay the prices in effect for your purchase, plus applicable taxes, and authorise us to charge your selected payment method.

For recurring subscriptions, you authorise recurring charges until you cancel. We may change prices, correct pricing or billing errors, and refuse orders, subject to applicable law and any agreement governing your purchase.

7. Free trial

We offer a 30-day free trial to new registered users. At the end of the trial, the free plan limits the number of workspaces and test cases and disables cloud sync.

8. Cancellation and refunds

You can cancel your subscription by contacting info@robonito.com or calling +91 90457 08272. Cancellation takes effect at the end of the current payment cycle.

If you are dissatisfied with the Service or want to discuss a refund, contact us using the same details. Nothing in these terms limits refund rights required by applicable law.

9. Software

Software supplied with a separate end-user licence agreement is governed by that agreement. Otherwise, we grant a non-exclusive, revocable, non-transferable licence to use it with the Service for personal or internal business purposes under these terms.

Software and documentation are provided as is, subject to applicable law. You may not reproduce or redistribute them except as permitted by their licence or these terms.

10. Prohibited activities

Use the Service for its intended testing and related business purposes. You must not:

  • Test systems without authorisation, break applicable laws, infringe intellectual property, or violate anyone’s privacy.
  • Mislead or impersonate others, obtain their credentials, create accounts under false pretences, or collect contact details for unsolicited messages.
  • Bypass authentication, access controls, security measures, or usage limits.
  • Upload malware, spyware, or spam; disrupt the Service or connected networks; or place an undue burden on them.
  • Harass or threaten people, harm others using information from the Service, or submit false abuse reports.
  • Scrape or compile Service content into a separate database or directory, or run unauthorised bots, robots, scripts, data-mining tools, or purchasing agents. Authorised MCP access under section 4 is permitted.
  • Copy or adapt Service software, remove proprietary notices, or reverse engineer it except where applicable law permits.
  • Use the Service to build a competing service, resell its content, advertise unrelated goods or services, or sell or transfer your account without permission. Internal business testing under section 2 is permitted.
  • Frame the Service or otherwise use it in ways we have not authorised.

11. Your content and feedback

You retain ownership of tests, conversations, and other content you submit. You must have the rights, consents, and permissions needed to provide that content and allow its processing under these terms, the Privacy Policy, and your settings.

Your content must not infringe rights, mislead others, include unauthorised advertising, harass or threaten people, promote violence or discrimination, or violate laws protecting children. Content you choose to share may be accessible to other users or third-party services.

We do not claim ownership of your content. You are responsible for your contributions and their statements and representations; to the extent permitted by law, we are not responsible for claims arising from them.

Questions, ideas, suggestions, and feedback about the Service are non-confidential submissions. These submissions become our property, including their intellectual property rights, and we may use and share them for any lawful purpose without acknowledgement or compensation. To the extent permitted by law, you waive moral rights in them and agree not to bring claims against us for their use. You must have the right to submit them. This feedback provision does not transfer ownership of your tests or application data.

12. U.S. government rights

Our services are commercial items under FAR 2.101. For U.S. agencies outside the Department of Defense, FAR 12.212 applies to software and FAR 12.211 to technical data. For Department of Defense acquisitions, DFARS 227.7202-3 applies to software and DFARS 252.227-7015 to technical data. Government use is subject to these terms to the extent those provisions permit.

13. Service management

We may monitor compliance, investigate violations, take appropriate legal action, restrict or disable content, and remove files that are excessive in size or burdensome to our systems. We manage the Service to protect our rights and support its proper operation.

14. Privacy and data

Our Privacy Policy explains collection, use, sharing, model training, retention, and your controls, including information returned to AI clients and sent to configured AI providers. It forms part of these terms.

Your data may be processed in India and other countries as described in that policy. You are responsible for maintaining copies of important test data. Subject to applicable law, we are not liable for loss or corruption of data you transmit to the Service.

15. Term and termination

These terms apply while you use the Service. We may deny access, suspend or terminate accounts, and remove content at our discretion, including for breaches of these terms or applicable law, subject to any mandatory legal requirements.

Do not evade a suspension or termination by creating an account under another name or on behalf of someone else. We may also pursue legal remedies. Data deletion and retention are addressed in the Privacy Policy.

16. Changes and availability

We may change, suspend, or discontinue the Service or its content. We do not guarantee continuous availability; maintenance, hardware, software, or other issues may cause delays or interruptions.

To the extent permitted by law and any separate agreement, we are not liable for changes or downtime and are not obliged to provide ongoing support, corrections, updates, or releases.

17. Governing law

These terms are governed by the laws of India. Subject to the dispute-resolution provisions below and applicable mandatory law, you and Robonito Pvt. Ltd. consent to the exclusive jurisdiction of the courts of India.

18. Dispute resolution

Binding arbitration

Any dispute arising out of or in connection with this contract, including its existence, validity, or termination, shall be referred to and finally resolved by the International Commercial Arbitration Court under the European Arbitration Chamber (Belgium, Brussels, Avenue Louise, 146), under its rules, which form part of this clause.

The number of arbitrators shall be __________. The seat, or legal place, of arbitration shall be India. The language of the arbitral proceedings shall be __________. The governing law of the contract shall be the substantive law of India.

Restrictions

Arbitration is limited to the dispute between the parties individually. To the fullest extent permitted by law, it may not be joined with another proceeding, brought as a class action, or brought in a representative capacity on behalf of the public or other people.

Exceptions to arbitration

The arbitration requirement does not apply to disputes seeking to enforce, protect, or challenge the validity of intellectual property rights; disputes involving theft, piracy, invasion of privacy, or unauthorised use; or claims for injunctive relief.

If part of this arbitration provision is illegal or unenforceable, disputes covered by that part shall instead be decided by a competent court within the jurisdiction stated above. The parties consent to that court’s personal jurisdiction.

19. Corrections

Service information may contain errors or omissions, including pricing, descriptions, or availability. We may correct or update it without prior notice, subject to applicable law.

20. Disclaimer

The Service is provided as is and as available. To the fullest extent permitted by law, we disclaim express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee the accuracy or completeness of content, uninterrupted transmissions, or freedom from errors or harmful third-party software. Subject to applicable law, we do not assume responsibility for content errors, injury or property damage arising from use, unauthorised server access, interruptions, malware, or losses resulting from Service content.

We do not endorse or guarantee third-party products or services linked or advertised through Robonito, and we are not a party to transactions between you and those providers. Review their terms and exercise appropriate care.

21. Limits of liability

To the extent permitted by law, Robonito and its directors, employees, and agents are not liable for direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, revenue, or data, arising from use of the Service, even if advised of their possibility.

Our total liability for any claim is limited to the amount, if any, you paid us during the six months before the cause of action arose. Where applicable law does not allow a disclaimer or limitation, it does not apply to you, and you retain your statutory rights.

22. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Robonito, its affiliates, and their officers, agents, partners, and employees against third-party claims, losses, liabilities, and reasonable legal fees arising from your use, breach of these terms or representations, infringement of third-party rights, or harmful acts towards another user.

We may take control of the defence of an indemnified claim at your expense. You agree to cooperate, and we will use reasonable efforts to notify you when we become aware of the claim.

23. Electronic communications

You consent to electronic communications, notices, contracts, orders, records, and signatures through the Service or email. To the extent permitted by law, these satisfy requirements for written communications and replace requirements for original signatures or non-electronic records and delivery.

24. California residents

If a complaint remains unresolved, California residents may contact the Complaint Assistance Unit, Division of Consumer Services, California Department of Consumer Affairs, at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210 or (916) 445-1254.

25. General provisions

These terms and the policies or operating rules incorporated into them form the entire agreement about the Service. Failure to enforce a provision is not a waiver. An unenforceable provision can be severed without affecting the remaining terms.

We may assign our rights and obligations as permitted by law. We are not responsible for failures beyond our reasonable control. Using the Service does not create a partnership, joint venture, employment, or agency relationship.

To the extent permitted by law, these terms are not construed against us solely because we drafted them, and their electronic form does not affect their enforceability.
